Follow-up sequence exceeding CASL implied consent window
Canadian automated follow-up sequences continuing beyond the two-year implied consent window for existing business relationship contacts are non-compliant with CASL. The implied consent window is shorter for a lead who made an enquiry but did not purchase than it is for an existing client. A lead who submitted a form enquiry eighteen months ago and has not purchased has a remaining implied consent window of six months; continuing to follow up after that window closes is a CASL violation. The CRM should track consent type and consent date and unenrol contacts automatically when their window expires.
