Each provincial College of Physicians and Surgeons maintains advertising guidelines that govern how physician practices can present themselves online. Comparative claims, superlative language about outcomes, and certain testimonial formats may breach these guidelines. Many Canadian healthcare websites carry copy that was not written with specific attention to these requirements. The risk varies by province and specialty, but it is present on more websites than practice owners realise.
Contact forms, booking request forms, and online intake forms collect patient information that is classified as personal health information under PIPEDA and, in Ontario, under PHIPA. Many websites collect this data without the consent architecture, privacy notices, and data handling documentation that legislation requires. Practices in Ontario, British Columbia, Alberta, and Quebec each operate under College guidelines that differ in detail, and copy written for one province is not automatically compliant in another. We document the applicable guidelines and write to them from the first draft.
For practices in Ontario, all data collection is built to PHIPA requirements in addition to PIPEDA. This means appropriate consent for the collection, use, and disclosure of personal health information, compliant privacy notices, data minimisation in form design, and documentation of data flows for all patient-facing collection points. We do not treat PIPEDA and PHIPA as interchangeable; PHIPA imposes specific additional requirements that are addressed explicitly in our build.
We have integrated healthcare websites with OTN (Ontario Telemedicine Network), Maple, Dialogue, Jane App, and various provincial virtual care platforms. Where your platform is not one we have previously integrated, we assess it during the diagnostic stage and confirm feasibility before the engagement begins.
